Frequently Asked Questions About Massachusetts Car Accidents

Frequently asked questions about Massachusetts car accidentsEach one of us at some time will likely be involved in a car accident.  The accident may be the fault of the other driver involved, it may be your fault, or a combination of the two.  If you recently had a car accident and you were injured, you may be considering filing a claim for your damages.  Below are some FAQ’s about these types of personal injury accidents in Massachusetts that hopefully will assist you.

What Is A Contingency Fee?

All Massachusetts injury lawyers that handle personal injury cases do so on a contingency fee basis.  But what is this exactly? Understanding this fee structure is important if you are dealing with either a personal injury or workmans’ compensation claim.

You may have come across attorney advertisements which say “no fee unless we win your case” or something very similar.  That is a contingency fee.  The fee owed to the attorney is only triggered, or contingent upon, the attorney obtaining financial compensation for the client.

Crane Topples Over In Seattle Killing Four

A crane fell from a building in Seattle yesterday, killing four. The crane fell from a building on Google’s new Seattle campus at the intersection of Mercer and Fairview Avenue, a very busy intersection.

Two of the dead are ironworkers that were in the crane at the time, and the two others were inside a parked car.  Apparently the crane was being dismantled and extremely high winds are believed to have played a role in the accident.  The accident is currently under investigation.

Never Trust An Insurance Adjuster

If you were involved in a car accident the person who caused the accident likely has car insurance.  That car insurance company assigns an adjuster to your case.  She may or may not have called you already.  If she has not called, she likely  will be soon.  You likely will receive a letter from her with forms to fill out.  Will you be ready?  If she is calling you she probably sounds really nice.  It sounds like she really cares about you.

After all, she is asking how you are doing, what kind of injuries you experienced in the car wreck.  She also may be telling you not to get a car accident lawyer.  That there is no reason to hire a lawyer since she is “going to take care of you.”  She sounds like she is on your side.  That could not be further from the truth.  This adjustet is calling you for one reason: to limit the amount of money the insurance company pays you for your accident claim.

Workers Compensation And Pain And Suffering

Oftentimes my clients who are injured at work want to know what their case is worth.  When I tell them they cannot collect pain and suffering for a workers comp claim they are understandably disappointed.  They justifiably expect to be able to sue their employer and collect pain and suffering, but they cannot.  However, they can collect sue and collect pain and suffering if their personal injuries were caused by a third-party.

For example, if you are driving a car for your employer and someone rear ends you, you have two possible claims.  You have a workers compensation case with your emoloyer’s workers comp insurance company.  This claim would be for payment of lost wages and medical bills. You also have a case against the driver for negligence for causing the car accident.  This claim would be for pain and suffering damages that were caused by the accident.
