When A Case Does Not Settle At Mediation

Through years of handling Massachusetts personal injury cases, I have found mediation to be a very effective tool for resolving accident cases that may or may not be in litigation.

Mediation is a process whereby the parties to a legal dispute agree to sit down with a mediator in an effort to resolve their dispute.  A mediator is a third-party neutral attorney who helps disputing parties resolve their differences and to come to an acceptable resolution.

Settlement For Client Injured In Car Accident

A large part of our Boston personal injury law practice involves representing people injured in motor vehicle accidents due to no fault of their own.  These cases include improper left-turns, rear-end accidents, improper lane changes, distracted driving, and other causes of car accidents.

In a recent motor vehicle accident case, our client, an elderly woman, was being transported in a van along with other passengers. The driver of the van was driving at a high-rate of speed.  The van struck a pothole, causing our client to be violently moved in her seat.  As a result, she sustained a serious burst fracture to her spine.  This required her to undergo serious and extensive medical treatment.  She would incur substantial medical bills.  She was prescribed a walker to help her ambulate while her spine healed.

Can I Sue For My Slip And Fall Accident?

It is surprising the number of people who have the misfortune of slipping and falling.  Some people that experience these accidents are injured as a result, and some are not. A common question from both categories of people is whether or not a lawsuit can be be filed.  Almost anyone can sue anyone else.  But, the real question is if the lawsuit will be worth it.

If a property owner fails to reasonably take care of, or maintain his property, and someone is injured, he can be sued for negligence in a Massachusetts court.   Negligence is a common word used in personal injury law which means someone was careless, or unreasonable in bringing about injury to someone.

Settlement For Client With Broken Wrist From A Slip And Fall
The Earley Law Group Injury Lawyers recently settled a slip and fall claim for $ 110,000.  The claim involved our client who slipped and fell on a property she was visiting.  The cause of the fall was a broken exterior light which was not working.  Our client therefore could not adequately see as it was dark out, and she fractured her left wrist in this slip and fall accident.  Due to the severity of the injuries involved, she eventually would have to undergo surgery to repair her broken wrist.
Slip and fall claims are examples of premises liability claims.  Massachusetts law requires all property owners to reasonably maintain their property.  If they fail to to do this, they can be held liable and potentially sued for negligence.  When broken bones (also called fractures) result from a property owner’s negligence, sizeable settlements typically result.

Settlement for Client With Significant Neck Injuries From Car Accident

Our client was operating her vehicle when she stopped at a crosswalk to allow pedestrians to cross the street.  While stopped at the crosswalk, she was rear ended by another vehicle. Immediately she felt pain.  She would go to the hospital where she was diagnosed with neck pain, as well as a concussion.  Due to the pain she ultimately underwent cervical fusion as she had sustained herniated discs from the accident.

A claim was presented to the at-fault driver’s insurance company.  Unfortunately, that driver only had $ 25,000 in compulsory bodily injury coverage.  After that full policy was paid out, we then presented an underinsured claim with our client’s own motor vehicle insurance company.  That claim settled for the maximum amount of underinsured motorist coverage which she carried under her policy, which was $ 100,000.  However, because she had already collected $ 25,000 from the bodily injury carrier, the most she could collect from the underinsured carrier was $ 75,000.  Therefore, both claims combined settled for the full available policy limits of $ 100,000.
