If you are involved in a car accident you are likely going to file a claim with your car insurance company, and if you were injured, with the insurance company for the driver that caused the accident. It is secret that insurance companies deny perfectly legitimate claims constantly. They do this because they don’t want to pay money out, they only want to collect and keep the money they make through the premiums they charge. Here are some reasons why insurance companies deny injury claims.
For car accident claims, they may argue that it was only a minor accident with little or no damage caused to the vehicles involved. They do this all the time. They claim that when the property damage is minor, that someone could not possibly have experienced personal injuries as a result. The fact is that there is no legitimacy to this argument. Just because a car was not damaged, does not mean a person inside the car was not injured.
They also argue that the driver they insurer is not responsible for causing the accident. They do this all the time. They do this many times with car accidents occurring at intersections, or failure to yield accidents. Remarkably they also do this with rear-end car accident claims.
With other claims such as slip and fall and trip and fall cases they will argue you alone were the cause of the accident. They will argue you were not looking where you were going, and that your negligence caused the accident. Or, for workers compensation accidents, they will deny claims for many reasons, most notably one claiming you are capable of performing your work duties.

What Can Be Done When A Claim Is Denied?

The two choices for a claimant when their claim is denied is to give up and walk away, or they can fight the denial. That is done by the filing of a lawsuit. I don’t recommend filing a lawsuit on your own. It is much too complicated and if you mess it up, your entire claim can get dismissed.
