Victims of personal injury accidents frequently are interested in learning about what they may be entitled to. They frequently want to know “How much will my case settle for?” The answer really depends on different factors. Here are some of the them.
1 – The injuries suffered. The value of a case is largely determined by how severe the injuries suffered from the accident turn out to be. Personal injury cases that result in modest injuries that resolve settle for less than cases resulting in serious and permanent injuries that last a lifetime. For example, a bicycle accident resulting in the need for surgery, will have a higher settlement than a claim for soft tissue injuries that resolve quickly.
2. Liability. Much of the settlement value of a personal injury claim depends on whether liability can be established. For example, if the personal injury victim bears some fault, or liability for causing the accident, the settlement value of his case will reduced. This is called comparative negligence.
3. Amount of medical bills. Almost all settlement are based in large part on the amount of medical bills related to the accident. Generally, the higher the bills, the higher the settlement, and vice versa.
4. Insurance coverage. The amount of any potential settlement for a personal injury accident is limited by the amount of insurance coverage available. For example, many bodily injury car accident insurance policies are only $20,000. If there are no available underinsured insurance available, regardless of the extent of injuries suffered, the settlement will be limited to the amount of available insurance.
The value of a personal injury case truly depends on many different factors. Each case is unique and must be evaluated on its own merits. There is no formula that can be used. Rather, consideration of all the factors of a given case, and trying to determine what a jury would award for the case, is the best and truest way to determine what a given case should settle for.
Please note the above applies to all personal injury cases, but does not apply to workers compensation case settlements. Those cases are primarily determined by how much an injured worker was making at the time of the accident, and what his injuries from the accident are.
