Boston is facing it’s first winter storm of the season. Substantial snow is expected to fall which will create dangerous conditions for drivers and pedestrians alike. That will inevitably result in people experiencing personal injuries from car accidents as well as from slip & fall accidents. Massachusetts law previously prevented many snow and ice victims from filing claims because an “unnatural accumulation” of snow or ice had to be shown before liability would attach to the property owner. That was very hard to do, which denied slip and fall injury victims access to courts. Now, Massachusetts law has changed so that the injury victim only needs to show that the property owner failed to reasonably clear the snow and ice that led to the injury. This was a watershed moment which was much needed.
