Who Pays My Medical Bills After a Massachuestts Car Accident?

Under Massachusetts law, the auto insurance company that insures the vehicle you were occupying at the time of the accident pays the first $2000.00 of your reasonable and necessary medical bills related to the accident.  If you were a pedestrian, or cyclist, the auto insurance company that insures the vehicle that struck you will pay for the first $2000.00 of your reasonable and necessary medical bills related to the accident.

Any bills after the first $2000.00 must be submitted to your private health insurance company for payment.  Whatever bills your health insurance company does not pay, are then kicked back to the auto insurance company for payment.  However, the auto insurance company is obligated to pay no more than $8000.00 per individual claimant.  

If you have missed time from work, the auto insurance company is only obligated to reimburse you for 75% of your lost wages.   But, the cap of $8000.00 applies also to lost wages.  Therefore, the auto insurance company is required only to pay a maximum of $8000.00 in medical bills and/or lost wages per individual claimant.  If you use up the $8000.0o in medical bills, then your lost wages will not be paid by the auto insurance company  Or, if you use up the $8000.00 in lost wages, then your medical bills will not be paid by the auto insurance company.
