Uninsured Motorist Coverage and Motorcycle Accidents in Massachusetts

Suppose hypothetically that you are driving a motorcycle on a Massachusetts roadway and suddenly, a vehicle cuts in front of you.  Further assume that this vehicle’s abrupt turn requires you to lay your bike down in order to avoid colliding with this vehicle.  Now, what if the vehicle speeds off and leaves the scene of the accident?

You cannot make a claim against the at-fault driver’s insurance company because you have no idea who the driver was since he/she left the scene.  What you can do is file an uninsured motorist claim with your insurance company.  This is essentially a claim where you are substituting your insurance coverage for the at-fault driver’s insurance coverage.

Your Massachusetts insurance company may deny uninsured motorist coverage since there was never a collision.  The reason for this is that Massachusetts insurance companies want to reduce the number of fraudulent claims because many people fall asleep behind the wheel and/or collide with objects while driving, and subsequently make a claim for uninsurance coverage.  If your insurance company denies your claim, I suggest that you contact a Massachusetts personal injury lawyer immediately.
