For many people involved in an auto accident, and who suffer personal injuries in the accident, they want to know about filing deadlines.  This is an important consideration because if certain deadlines are not met, a claim can be time-based.  Here are the time limits on filing a Boston car accident claim.
Generally, you have three years from the date of the accident to file a lawsuit.  This is called the statute of limitations.  You can file a claim at anytime prior to this three-year mark, but if you do not, and if you, or your car accident lawyer does not within this time period, you will forever be time-barred.  This is a firm deadline with no exceptions.
Most Massachusetts personal injury claims have a three-year statute of limitations including dog bites, motorcycle crashes, truck accidents, pedestrians accidents, and all other injury claims.
If however the claim involves a minor, the minor has three years from their 18th birthday to file a claim.  For cases against the MBTA, they too have a three-year statute of limitations.  But, with these cases a presentment letter must be filed no later than two years following the accident.
