Most cases settle without the need to file a lawsuit. Other cases fail to settle at the claims stage, and must be filed in court. Keep in mind, just because your case was filed in court does not mean you yourself will have to go to court.
Your injury lawyer will attend all court events such as a Case Management Conference, Pre-Trial Conference, and will also go to court to argue any motions that are filed.
If however your case does not settle either before, during, or after discovery, then the case will need to be tried to verdict in front of a judge and jury. You would be required to attend the trial with your lawyer(s). This is the only time you would need to go to court during the life of your personal injury case.
