Generally, you have three years from the date of the accident to file a lawsuit. This is called the statute of limitations. This is a firm deadline with no exceptions.
If however the claim involves a minor, the minor has three years from their 18th birthday to file a claim. For cases against the MBTA, they too have a three-year statute of limitations. But, with these cases a presentment letter must be filed no later than two years following the accident.
